Terms of Service

These terms govern your use of erni.ai and of Erni, the software assistant operated by Erni.ai (“Erni”, “we”, “us”). By using erni.ai you agree to them. If you use Erni for a business, you confirm you may accept these terms for it.

What Erni is, and is not

• Erni is software. Erni.ai is not a licensed insurance producer, broker or agent. Erni does not sell, solicit or negotiate insurance, does not quote, and does not bind coverage.
• Erni tells you what public records and your documents state, and how documents compare. A comparison compares what the documents state. It isn’t a coverage decision, legal advice, or a statement that you are or are not covered.
• When you ask, we can connect you with a licensed insurance broker. The broker is independent of us and is responsible for any advice, quote or policy they provide.

Information may be incomplete

Erni relies on public records, on what you tell it, and on AI models that read text and documents. Public records can be out of date, documents can be incomplete, and AI output can be wrong. Check anything important with the source, your insurer or a licensed professional before you rely on it.

Your responsibilities

• Give accurate information, and only upload documents you have the right to share.
• Do not misuse the service: no unlawful use, no attempts to break or overload it, no automated access or scraping, and no attempts to make Erni produce harmful content.
• Do not upload other people’s sensitive personal information unless you are permitted to.

Your content

You keep ownership of what you type and upload. You let us use it to provide and improve the service, as described in our Privacy Policy.

Our service

Erni, erni.ai and their content belong to Erni.ai. We may change, suspend or stop any part of the service at any time, and we may limit or end access for anyone who breaks these terms.

No warranty

The service is provided “as is” and “as available”, without warranties of any kind, including accuracy, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, Erni.ai is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or business, arising from your use of the service or reliance on it. Our total liability for any claim relating to the service is limited to one hundred US dollars (US$100). Some jurisdictions do not allow these limits, so they may not apply to you.

Indemnity

You agree to cover our reasonable losses from claims that arise because you broke these terms or uploaded content you had no right to share.

Law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Disputes will be heard in the state or federal courts located in Orange County, California, unless the law requires otherwise.

Changes

If we change these terms, we will post the new version here with a new effective date. Continuing to use the service after that means you accept the change.
